TERMS AND CONDITIONS: THE CYBER TECH OF THE WORLD (TCT)

1. INTRODUCTION

1.1 These Terms and Conditions (“Terms”) govern the provision of IT and Cybersecurity services by V S Productions Pty Ltd (ABN: 66676295015) T/A The Cyber Tech (also referred to as “The Cyber Tech of the World”, “we”, “us”, “our”) to you (“Client”, “you”).

1.2 By accessing our websites (thecybertechs.com, thecybertech.com.au) or engaging our services, you agree to be bound by these Terms.

2. SCOPE OF SERVICES & AI DISCLAIMER

2.1 We provide Managed IT Services and AI-Powered Cybersecurity solutions. The specific scope is defined in your Service Level Agreement (SLA).

2.2 AI-Powered Services: You acknowledge that our AI-driven threat detection utilizes probabilistic models. While highly effective, we do not warrant that AI tools will identify 100% of threats or be free from “false positives.”

3. CYBERSECURITY SHARED RESPONSIBILITY

3.1 Mandatory Standards: You must maintain the “Minimum Security Standards” we recommend, including Multi-Factor Authentication (MFA).

3.2 Indemnity for Refusal: If you decline our security recommendations (e.g., refusing a critical patch or MFA), V S Productions Pty Ltd is fully indemnified against any resulting breach, ransomware incident, or data loss.

4. FEES AND PAYMENT

4.1 Payment Terms: Invoices are issued in advance and are payable within seven (7) days.

4.2 Suspension: We reserve the right to suspend security monitoring and support if an invoice remains unpaid for more than 14 days. We are not liable for any cyber incidents that occur during a suspension for non-payment.

5. LIMITATION OF LIABILITY

5.1 To the extent permitted by the Australian Consumer Law, our total liability for any claim is limited to:

The total fees paid by you in the six (6) months preceding the event; or
The cost of resupplying the services.
5.2 We are not liable for indirect or consequential losses, including loss of profit, loss of data, or “special damages” arising from third-party cyber-attacks.

6. GOVERNING LAW

6.1 These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts in Melbourne, Victoria.
